The most common questions from our clients about real estate law in Austria.
In Austria, escrow handling is legally required. The purchase price must be processed through an escrow agent. Without this safeguard, buyers are not legally protected.
The purchase price is held by a lawyer until the buyer is officially registered in the land registry. Only then does the money go to the seller. This prevents funds from being transferred before ownership is legally secured.
We review ownership in the land registry, existing liens or encumbrances, whether the floor plan matches the actual property, and all legal clauses to protect the buyer.
From signing the contract to registration in the land registry, the process usually takes 4 to 8 weeks. The exact duration depends on the complexity of the case.
The land registry is the official Austrian register of all properties and their owners. Legally, you only become the owner of a property once you are entered in the land registry — not when you sign the contract.
Property gifts are possible but must be notarised and registered in the land registry. Even between family members, a legally valid contract is required. A verbal agreement is not sufficient.
When you buy a condominium, you acquire not only your own unit but also a co-ownership share in the entire building. Decisions about the building and the associated costs are made jointly with all owners.
